Terms and Conditions for the “UK Guitar Show” Competition
- SCOPE OF THESE TERMS AND CONDITIONS:
- These Terms and Conditions apply to the “UK Guitar Show” Competition [the “Competition”] as described below.
- This competition is held by Yamaha Music Europe GmbH (UK), Sherbourne Drive, Tilbrook, Milton Keynes, MK7 8BL, United Kingdom [the “Yamaha”]
- By submitting their entry to participate in this competition, entrants agree that they have read, understood and accepted these Terms and Conditions.
- COMPETITION – MECHANISM
- The Competition runs from 00:00 am GMT on Monday 13th August 2018 until 12:00 pm GMT on Friday 17th August 2018 [the “Competition Period”]. Entries submitted before or after the Competition Period will not be eligible.
- The Competition is open only to residents of the United Kingdom, who are 18 years and over. Any attempt to enter this Competition from a country outside of the United Kingdom will be discounted. Yamaha employees and their family members, the agencies or anyone professionally connected with this Competition are not eligible for this competition.
- In order to enter the Competition, entrants must like the Yamaha Guitars Facbook Page (to be found at: www.facebook.com/YamahaGuitarsOfficial) and name their favourite Yamaha Guitar in the comments section underneath the competition post. No other entry will be possible.
- There is a limit of one entry per person. Multiple entries from the same person will be disqualified. Any entries attempted through the use of agencies or robotic, repetitive, automatic, programmed, or similar methods will be void. Entries that are incomplete, illegible or incorrect will be rejected.
- COMPETITION – THE PRIZE:
- There will be one Prize only consisting of 2 tickets to the UK Guitar Show (the “Prize”) valid for either Saturday 29th September 2018 or Sunday 30th September 2018 at Olympia London, Hammersmith Rd, London W14 8UX, United Kingdom. The tickets will only be valid for entry to the UK Guitar Show and do not include tickets for the main stage performances.
- The winner will be chosen randomly on Friday 17th August 2018 at 17:oo pm GMT. The winner will be able to collect the Prize at the ticketing gate at the event Olympia London Hammersmith Rd, London W14 8UX, United Kingdom.
- Yamaha will notify the Winner by direct message on Facebook on 17th August 2018. If Yamaha is unable to contact the Winner within seven (7) days or if that potential Winner is not in compliance with these Official Rules, the prize will be forfeited and, at Yamaha’s discretion, an alternative Winner will be selected using the same drawing process. Yamaha’s decision in respect of all matters to do with the Competition will be final and no correspondence will be entered into.
- The Winner cannot obtain cash or other substitution in lieu of the Prize. Yamaha reserves the right to change any of these terms and conditions from time to time without notice and to take appropriate action including cancellation of the Prize if, at its discretion, it deems such action necessary. Yamaha shall not be liable in any way for any dispute which may arise in connection with the allocation of the Prize.
- COMPETITION REQUIREMENT:
- Yamaha shall not be responsible for monitoring the entrants’ uploaded content, however Yamaha reserves the right to reject any content that Yamaha may consider to be illegal.
- Yamaha reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these Terms and Conditions. Yamaha may do so retroactively and recall the Prize.
- By entering the competition, all entrants represent and warrant that their entry does not contain any so called samples and/or other copyright material owned by a third party, any personal rights, insults, copyright violations, trademark infringements.
- The entrant shall indemnify Yamaha on first demand from any claims by third parties due to the entrant’s contribution to illegal content.
- DISCLAIMER:
- Yamaha shall not be liable for any failure to meet this Terms and Conditions where such failure is cause by any supervening circumstances amounting to force majeure. Such circumstances shall include, but shall not be limited to, technical problems, change of terms and conditions or decisions by platforms such as Facebook, Instagram, Snapchat or Twitter, severe weather conditions, fire, flood, war, earthquake, riots, industrial dispute, terrorism, acts of god, or events that, without fault of either party, render performance impossible or incapable of satisfactory execution.
- LIABILITY:
- Notwithstanding mandatory law, Yamaha’s liability for compensation of damages shall be excluded or limited as defined in this number 6:
- Yamaha’s liability shall be unlimited regarding damage from deliberate or grossly negligent violation of duty by Yamaha or one of its legal representatives.
- Yamaha shall further be liable where the damage results from negligent violation of essential contractual duties. Essential contractual duties are all of those obligations, the fulfilment of which is a prerequisite for enabling the proper fulfilment of the contract in the first place and upon their compliance the contractual partner may normally trust. In this case Yamaha’s liability is, however, limited with regards to the amount, in accordance with the contractually typical foreseeable damage at the time of the conclusion of the contract.
- Yamaha’s liability shall not be excluded if the damage occurs from injury to life, body, or health which rests on a deliberate or negligent violation of duty by Yamaha or by one of its legal representatives or where Yamaha is subject to a mandatory legal liability, in particular liability in accordance with product liability law.
- As far as Yamaha’s liability is excluded or limited according to the above provisions, this also applies to the personal liability of Yamaha’s legal representatives, employees, staff, and proxies.
- PRIVACY POLICY:
- This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, or any other Social Network
- Yamaha may collect any personal data which is publicly available on an entrant's social media profile, including their name and social media name. Yamaha may also request that the Winner provide further personal data including their name, age and email address once the Winner has been selected. Entrants consent to this personal data being used by Yamaha for the purpose of administering and executing the Competition and, in respect of the Winner, announcing his/her name on the Yamaha website and/or any of its social media channels. Any personal data processed by Yamaha will otherwise be processed in conjunction with the following Privacy Policy found at: https://uk.yamaha.com/en/privacy_policy/.
- OTHER:
- If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced.
- These terms and conditions and any disputes or claims arising out of or in connection with them shall be governed by the laws of England and participants agree that the courts of England shall have exclusive jurisdiction.
